Galway Cartridge retains title to all goods supplied to you until such time as they have been paid for in full.
We have made every effort to clearly identify the products in our shop or in any promotional material, but Galway Cartridge doesn't accept liability for products that are accidentally described incorrectly.
Very many of the product descriptions contain the phrases 'page yield', 'product capacity' or 'capacity of'. The page yields mentioned in these descriptions are based on the industry standard of 5% coverage (i.e. 5% of the area of the page has been printed on), in accordance with ISO/IEC 19752 testing methodology. This is how printer manufacturers describe their page yields. Obviously if you're printing two or three lines of standard-size text per page you're very likely to exceed the stated page yield, and if you're printing an A4-sized black box you won't get the yield that's mentioned in the description. Yields vary with usage and environmental conditions.
So in short, the page yield is subject to many factors, and therefore, Galway Cartridge disclaims responsibility for cartridges that don't print the number of pages that's advertised, as the OEMs themselves say that the yield is only a guideline.
According to the EU Distance Selling Directive, the consumer is protected by a number of safeguards and entitlements. Galway Cartridge is committed to complying with this directive. You are entitled to a seven-day 'cooling-off period', whereby you are entitled to return your purchase to us for any reason within seven days of receipt of same, and be refunded the price that you paid, minus any shipping charge. This applies only where the products in question are unused, unopened , undamaged and returned to us in full saleable condition. Charges for return-shipment must be borne by the purchaser. In the event that you have ordered the incorrect consumables for your machine, and opened same (outer box or inner packaging) then we cannot refund in part or full. For items ordered incorrectly, or for items that are not required any longer, Galway Cartridge reserves the right to decline to accept returns and also to levy a re-stocking fee.

In the event that you've purchased a faulty original or OEM product from Galway Cartridge, please contact the manufacturer directly for further instruction. Many original equipment manufacturers require that the end-user initiate such returns procedures directly with them (but we will of course honour the guarantee if the OEM suggests that course of action). The warranty period is limited to 12 months from date of invoice. Please feel free to contact us with any queries you might have.
2. Compatible products:
In the event that your compatible purchase is faulty, Galway Cartridge undertakes to replace said product or refund the product purchase price, for a period of 12 months from the date of purchase.
3. Re-manufactured products:
In the event that your re-manufactured purchase is faulty, Galway Cartridge undertakes to replace said product or refund the product purchase price, for a period of 12 months from the date of purchase.
We are happy to accept items returned to us within 28 days of purchase and in this case we offer you an exchange or a full refund to your credit or debit card once we receive the items back and process the refund.
Any returns which falls outside this 28 day time period may be considered on a case-by-case basis and is at the discretion of Galway Cartridge and may be refunded as a credit against a future purchase. All items must be returned to Galway Cartridge in the same condition in which they were sold and in a saleable condition.
Galway Cartridge reserves the right to refuse a return if it is determined that the item has been used or worn and then returned for any reason other than being ‘faulty’.
Taxes
All products offered for sale in the shop display prices inclusive of VAT at the prevailing rate in Ireland.
All Products remain the property of Galway Cartridge until paid in full. Unless otherwise stated, all payments shall be due upon receipt of an invoice. Galway Cartridge reserves the right to obtain a security interest in all products sold to the customer, and in proceeds thereof, until the customer makes full payment. A €30 collection fee will be charged for any and all dishonoured cheques. Our Company reserves the right to charge interest on overdue accounts at the rate of 5% per month.
Galway Cartridge reserves the rights to change the prices of any or all of its products without prior notification.
Galway Cartridge liability for delivery shall cease, and title and all risk of loss or damage to the products as a result of misuse, or damage to personal property as a result of misuse shall pass on to the customer.
Terms of Limited Warranty
Galway Cartridge warrants to the original customer purchasing such products directly from Galway Cartridge that all such products sold will be free from defects in materials and workmanship affecting form, fit and function. Any claim alleging that any product fails to conform to the foregoing warranty may be made only by the customer who purchased such product and only while such customer owns such product. Galway Cartridge, at its option, will repair, replace, or provide a credit or refund of either the original purchase price or fair market value, whichever is lower, for a product that is determined by Galway Cartridge to be defective. Galway Cartridge reserves the right to substitute functionally equivalent new or serviceable used parts. The Limited Warranty covers only defects arising under normal use and does not include malfunctions or failures resulting from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature or improper installation or repairs made by anyone other than Galway Cartridge.
Galway Cartridge makes no warranties, expressed Or implied, including, but not limited to, any implied warranties of merchant ability or fitness for a particular purpose other than that Galway Cartridge warrants that such products are suitable for use in the particular machine for which they are designed. Any claim with respect to such products must be made 30 days from the original date of purchase from the Galway Cartridge premises and Galway Cartridge shall have no liability thereafter. All Warranties cover only defects arising under normal use and do not include malfunctions or failure resulting from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature or improper installation or repairs made by anyone other than Galway Cartridge or a Galway Cartridge authorized third-party service provider. Galway Cartridge, at its discretion, will repair, replace, or provide a credit or refund of either the original purchase price or fair market value, whichever is lower, for any product covered by the foregoing warranty that is determined by Galway Cartridge to be defective. Galway Cartridge reserves the right to substitute functionally equivalent new or serviceable used parts.
Galway cartridge makes no warranties, expressed or implied, and Galway Cartridge disclaims and negates all other warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, conformity to models or samples, or any warranties or indemnities against intellectual property infringement. In no event shall Galway Cartridge be liable for any indirect, special, incidental or consequential damages. All disputes arising out of or related to the limited warranties set forth herein (customer disputes) shall be governed by the laws of the Republic of Ireland. Claims against Galway Cartridge for shortages shall be deemed waived if not made within three (3) business days after purchase of product(s).
Customers shall not engage in the business of reselling products purchased from Galway Cartridge, or remove any components from our products for resale, except with prior written authorization from Galway Cartridge.
Customer may not assign its rights or obligations hereunder without the express prior written consent of Galway Cartridge.
These terms and conditions, including those on the face hereof, constitute the entire agreement with regard to this sale and expressly supersede and replace any prior or contemporaneous agreements, whether written or oral, relating to said sale, including any terms and conditions on any of customers documents or purchase orders. This agreement shall be binding upon the heirs, successors and assigns of the parties hereto. If any provision of this agreement shall be held to be invalid or unenforceable, the remainder of this agreement shall remain in full force and effect.
This agreement is governed by the laws of the Republic Of Ireland, without regard to its conflict or choice of law provisions. Customer acknowledges and agrees that the Republic Of Ireland is an appropriate place for venue of any litigation and that Republic Of Ireland courts have jurisdiction over this agreement and customer. In the event the customer and Galway Cartridge are unable to resolve any customer dispute, and any collection action, suit or other judicial proceeding is commenced, the prevailing party in any such collection action, suit or judicial proceeding shall be entitled to recover its costs and reasonable legal fees incurred.
GENERAL CONDITIONS
Galway Cartridge reserves the right to refuse admission/service to anyone for any reason at any time.
Customers understand that their content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. Customers agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by Galway Cartridge. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
This sale is subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by customer, including, without limitation, purchase orders and specifications. In case of conflict between the terms and conditions stated here and those on the face hereof, those on the face hereof shall control. Any additional, different or conflicting terms and conditions on any such document issued by customer at any time are hereby objected to by Galway Cartridge, and any such document shall be wholly inapplicable to any sale made hereunder and shall not be binding in any way on Galway Cartridge.
